A missed annual Clearinghouse query is one of the easiest FMCSA violations to rack up — not because the rule is complicated, but because it's a once-a-year task that's simple to lose track of across a roster of drivers. See how driver compliance tracking fits into a demo before your next query cycle is due.
FMCSA Clearinghouse Compliance for Bus Fleets
The Drug and Alcohol Clearinghouse is a federal database of CDL holders' drug and alcohol program violations. Every employer with CDL drivers has two separate query obligations — one at hire, one every year after — and missing either one is a compliance gap an audit will catch.
Pre-Employment Full Query
- Requires the driver's specific consent
- Required before the driver performs any safety-sensitive function
- Reveals actual violation details, if any exist
Annual Query
- Full or limited query, for every driver subject to testing
- A limited query only confirms whether a record exists
- A hit on a limited query requires a full query within 24 hours
What Counts as a Clearinghouse Violation
A Clearinghouse record is created when a CDL driver has one of the following, reported by employers, medical review officers, or substance abuse professionals:
- A verified positive, adulterated, or substituted controlled substances test
- An alcohol confirmation test result of 0.04 or higher
- A refusal to test under 49 CFR 382.211
- An employer's actual knowledge of an on-duty, pre-duty, post-accident, or controlled substance use violation
Once a violation is reported, the driver cannot perform safety-sensitive functions — including driving — until the return-to-duty process is resolved. Keep driver eligibility status visible across your fleet.
If a Query Returns a Hit
Limited query flags a record
The annual limited query shows only that information exists — not what it is.
Full query required within 24 hours
The employer must run a full query to see the details. Miss the window and the driver can't be cleared to drive.
Driver is prohibited from safety-sensitive functions
Until the SAP return-to-duty process is complete, or the driver has a negative RTD test and is in an employer-managed follow-up plan.

Content here is grounded in 49 CFR Part 382, Subpart G, and FMCSA's own Clearinghouse Final Rule summary — query fee amounts and minor procedural details can change, so confirm current figures directly with FMCSA. Talk through how your fleet currently tracks query dates.
The Bottom Line
The Clearinghouse itself isn't complicated — query at hire, query every year, and act fast if either one returns a hit. What trips fleets up is tracking it consistently across every CDL driver on the roster, year after year, without a system that flags the due date before it's missed.
